１．「表現の自由」は，「流通の自由」なくして保障しえない．

２．行政に利用される「自主規制」の倒錯→権力との緊張関係が希薄．

３．「表現の自由に値しない表現」という言説の無意味さ．表現の自由に値しない表現をいったい誰が決めるのか．警察や行政にその役目を負わせてはならない．

４．差別表現の問題を考えていくためにも，性表現に対する規制は，議論の障害にしかならない．

５．子どもの「自己決定権」との関係．大人の都合で，「教育」し，「指導」し，「保護」し，さらに大人の勝手な思い込みで「健全育成」しようというのは，子どもの「自己決定権」への侵害ではないか．むしろ「子どもの権利法」こそが必要である．

図書規制は，判例がどうであろうと，表現の自由に抵触するのは間違いない．しかも警察的な発想で規制が行われるのは，民主主義に反する大きな問題 だ．それだけでなく，子どもを「保護･育成」しなければならない存在としてみるのか，子どもの権利の主体としてみるのかという，二つの子ども観のせめぎ会 いでもある．表現活動を制限することによって，一方に偏した多数派の子ども観が「蔓延」させてはならない．
